1. Scope of Application
These General Terms and Conditions (T) apply to all orders placed by consumers or businesses via the online shop www.swing-baby.com
of amber marketing GmbH.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (§ 1 KSchG). A business is a natural or legal person or a legal partnership that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to order.
By clicking the “Buy Now” button, you place a binding order for the goods contained in your shopping cart.
The purchase agreement is concluded as soon as we accept your order by sending an order confirmation via email.
4. Prices and Shipping Costs
All prices are final prices in Euros and include statutory VAT.
Any additional shipping costs will be shown separately during the ordering process.

6. Delivery Shipping

Partial deliveries are permissible, provided they are reasonable for you.
7. Retention of Title
The goods remain our property until full payment.
8. Right of Withdrawal
Consumers have the statutory right of withdrawal according to the Austrian FAGG.

9. Warranty and Liability
The statutory warranty according to the provisions of the ABGB and KSchG applies.
We are not liable for damages caused by slight negligence, with the exception of personal injury or damage to items taken for processing.
Further claims for damages, in particular for lost profits or other financial losses, are excluded, unless liability is mandatory by law.
10. Data Protection
We process your personal data exclusively within the framework of applicable data protection laws.

11. Jurisdiction and Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers: If you have your domicile or habitual residence in Austria or are employed there, you can only bring legal action against us before the domestic courts of your domicile, habitual residence, or place of employment.
For businesses, the place of jurisdiction is Vienna.
